§ 1. General

apply to all contracts of the Rust GmbH with consumers, which take place in the online shop on swissvitalherbs.com. A consumer is any natural person who concludes a legal transaction for a purpose that can not be attributed to either his commercial or his independent professional activity. You have the opportunity to view and print the terms and conditions as part of the ordering process. The applicable form can be found at swissvitalherbs.com. By placing your order, you agree to the terms and conditions valid at the time of the order.

(2) The purchase contract is concluded with Rust GmbH. You can contact our Customer Service for questions, complaints and complaints via email at info@swissvitalherbs.com.

§ 2. Conclusion of contract

(1) With your order you make a binding offer to us to conclude a contract with you. By sending an order confirmation by e-mail to you or the delivery of the ordered goods, we can accept this offer. First, you will receive a confirmation of receipt of your order by e-mail to the e-mail address you have provided (order confirmation). However, a purchase contract only comes into effect with the dispatch of our order confirmation by e-mail to you or with the delivery of the ordered goods.

(2) When ordering via our online shop, the order process comprises a total of four steps. In the first step you select the desired goods. In the second step, enter your customer data, including billing address and, if applicable, different delivery address. In the third step you choose how you want to pay. In the last step, you have the opportunity to review all information (such as name, address, method of payment, ordered items) again and correct if necessary, before you submit your order by clicking on 'buy now' to us.

(3) We will send you an order confirmation and an order confirmation with all order data to the e-mail address you provided.

(4) The provision of the service by us presupposes the correctness and completeness of the data and information you have provided to us.

§ 3. Prices, shipping costs, return costs upon revocation

(1) All prices are inclusive of VAT. The prices are stated explicitly during the ordering process.

(2) The prices shown on swissvitalherbs.com are valid for purchase in the online shop

(3) The product prices quoted are the final costs. If necessary, there are additional costs for shipping. However, these are clearly identified.

(4) In so far as you make use of an existing right of revocation, you have to bear the direct costs of the return. This also applies if you have not yet provided the consideration or a contractually agreed partial payment at the time of the revocation.

§ 4. Terms of payment

The payment is made either in advance by advance transfer, via PayPal or by credit card. We reserve the right to exclude individual payment methods. If you choose the payment method in advance we will give you the bank details in the order confirmation. The invoice amount must be transferred to our account within 5 working days.

§ 5. Retention of title

The goods remain the property of Rust GmbH until full payment.

§ 6. Cancellation policy

You have the right to revoke the contract of sale within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the last partial shipment or the last part of the goods.

In order to exercise your right of revocation, you must inform us (Rust GmbH, PO Box 104, CH-8306 Brüttisellen / ZH, e-mail: info@swissvitalherbs.com) by means of a clear, written declaration (eg a letter sent by post or e-mail ) about your decision to withdraw from this contract. You can use the attached model withdrawal form, which is not required. You can electronically complete and submit the model withdrawal form on our website. If you make use of this option, we will promptly (for example by e-mail) send you a confirmation of receipt of such withdrawal. In order to maintain the cancellation period, it is sufficient that you send the notice of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of the cancellation
If you withdraw from this Agreement, we have selected all payments we have received from you, including delivery charges (except for any additional costs arising from choosing a different delivery method than our standard low cost delivery have to repay) immediately and at the latest within fourteen days from the date on which the notification of your revocation of this contract has reached us. For this repayment, we use the same means of payment that you used in the original transaction, unless otherwise agreed with you; In no case will you be charged for this repayment fees.

We can refuse the repayment until we get the goods back and have checked them for new value.

You have to return the goods immediately and in any event no later than fourteen days from receipt of the goods (invoice date + 2 working days) or from the day on which you inform us of the cancellation of this contract to us or hand over. The deadline is met if you send the goods before the expiry of the period of fourteen days. You bear the immediate costs of returning the goods.

You only have to pay for a possible loss in value of the goods, if this loss of value is due to a handling that is not necessary for the examination of the nature, characteristics and functionality of the goods. For reasons of safety and hygiene of our products, we must insist that the returned items arrive unopened and as new. No refund can be given before arrival and inspection of the returned goods. Payments by way of goodwill are reserved. A possible goodwill is subject solely to the decision of the Rust GmbH.

Special instructions:
In the event of a service, your right of revocation expires prematurely if the contract has been completely fulfilled by you and us at your express request before you have exercised your right of revocation.

Exclusion of the right of withdrawal:
The right of withdrawal does not exist with contracts

  • for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is authoritative or which are clearly tailored to the personal needs of the consumer. These include the delivery of goods that can spoil quickly or whose expiration date would be quickly exceeded,
  • for the delivery of sealed goods that are not suitable for return for reasons of health or hygiene, if their seal has been removed after delivery,
  • for the delivery of goods, if, due to their nature, they were inseparably mixed with other goods after delivery,
  • to deliver sound or video recordings or computer software in a sealed package if the seal has been removed after delivery

§ 7. Delivery Terms

1) Delivery times are the delivery times specified in the offer, these begin with receipt of payment. When paying by direct debit, the delivery times begin with acceptance of the contract by us.

(2) We deliver exclusively to Switzerland and the Principality of Liechtenstein.

§ 8. Warranty

The warranty is governed by the statutory provisions. As far as used goods are the subject of the purchase contract and the buyer is not a consumer, the warranty is excluded. If the customer is a consumer, the warranty period for the purchase of used items is one year.

§ 9. Data Protection

We generally refer to the privacy policy, which can be found at www.swissvitalherbs.com/privacy-policy.

(1) When initiating, concluding, processing and reversing a purchase contract, we collect, store and process data in accordance with the statutory provisions. When you visit our website, the IP address, date and time currently used by your PC, the browser type and operating system of your PC and the pages you are viewing are logged. However, conclusions about personal data are not possible or intended.

(2) The personal data that you provide to us, e.g. when placing an order or by e-mail (eg your name and contact details) will only be processed to correspond with you and only for the purpose for which you provided us with the data. We only pass on your data to the shipping company commissioned with the delivery, insofar as this is necessary for the delivery of the goods. To process payments, we pass on your payment data to the bank responsible for the payment.

(3) We assure that we do not pass on your personal data to third parties, unless we are legally obliged to do so or you have previously expressly consented. In so far as we use the services of third parties for the execution and processing of processing processes, the provisions of the Data Protection Act shall be observed.

(4) Personal data that has been communicated to us via our website will only be stored until the purpose for which it was entrusted to us is fulfilled. As far as commercial and tax retention periods are to be considered, the duration of the storage of certain data can be up to 10 years.

As far as we refer or link from our internet offer on the web pages of third, we can not take over guarantee and adhesion for the correctness and / or completeness of the contents and the data security of these web sites. § 11. Copyright

All displayed foreign logos, pictures and graphics are property of the respective companies and are subject to the copyright of the respective licensors. All photos, logos, texts, reports, scripts and programming routines shown on these pages, which are our own developments or have been prepared by us, may not be copied or otherwise used without our consent.

§ 12. Contract language

The language available for the contract is German.

§ 13. Salvatorian hermitage

Should any provision of these General Terms and Conditions be wholly or partially invalid or lose their legal validity at a later date, this shall not affect the validity of the remaining provisions. In place of the ineffective provision, by means of the adaptation of the contract, another appropriate provision shall be deemed to be closest in economic terms to what the contracting parties would have wanted if they had been aware of the ineffectiveness of the provision.

§ 14. Place of Performance, Jurisdiction, Applicable Law

(1) Place of performance is 8306 Brüttisellen / ZH.

(2) As the exclusive place of jurisdiction for all disputes arising from the contract, the district court Uster / ZH (8610 Uster) shall be deemed agreed.

(3) Exclusively Swiss law applies. This choice of law applies to a consumer only to the extent that it does not restrict any mandatory statutory provisions of the state in which he has his domicile or habitual residence.
